Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("User," "you") and Inuson International Inc., operating as TabEmail ("Company," "we," "us"), regarding your use of the TabEmail platform at tabemail.com and all related services ("Service").

By accessing or using the Service — including creating an account, clicking "I agree," or otherwise using any feature — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy in full. If you do not agree, do not use the Service.

You must be at least 18 years of age to use TabEmail. By using the Service, you represent and warrant that:

• You are at least 18 years old and have the legal capacity to enter into binding contracts;
• Your use will not violate any applicable law or regulation in your jurisdiction;
• If using on behalf of a business entity, you have the authority to bind that entity to these Terms.

TabEmail is designed for B2B commercial email outreach. Using the Service for consumer-targeted campaigns may violate applicable law and is prohibited under these Terms.

To access most features, you must register for an account. You agree to provide accurate, current, and complete registration information and to keep it updated. You are solely responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

Subject to these Terms, TabEmail grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for lawful business purposes including:

• Sending B2B cold email outreach campaigns to legitimate business prospects;
• Managing email sequences and automated follow-ups;
• Tracking email engagement metrics for your campaigns;
• Connecting and managing your authorized email accounts and sending infrastructure;
• Accessing analytics, reporting, and AI features within the Service.

You may not use the Service for any unlawful purpose or in any way that harms TabEmail, other users, or third parties. Specifically, you must not:

• Send unsolicited bulk email ("spam") in violation of CAN-SPAM, GDPR, CASL, or any other applicable anti-spam law;
• Send emails to individuals who have opted out or unsubscribed from commercial communications;
• Use harvested, purchased, or scraped email lists from unauthorized sources;
• Send emails containing malicious content, phishing attempts, malware, or deceptive material;
• Impersonate any person or entity, or falsely represent your affiliation;
• Attempt to reverse engineer, decompile, or disassemble any part of the Service;
• Resell or sublicense the Service without prior written permission from TabEmail;
• Use the Service to engage in fraud, abuse, or any illegal activity.

TabEmail offers a free Starter plan and paid subscription plans as described on our Pricing page. By subscribing to a paid plan, you authorize TabEmail to charge your payment method on a recurring basis.

• Billing Cycle: Monthly or annual, as selected at signup.
• Upgrades: Take effect immediately; prorated charges apply.
• Downgrades & Cancellations: Apply at the end of your current billing period. No partial refunds for unused time unless required by law.
• 30-Day Guarantee: New paid subscribers may request a full refund within 30 days of their first paid charge by contacting support@tabemail.com.
• Price Changes: We will provide 30 days' written notice before changing subscription prices. Continued use constitutes acceptance.
• Taxes: Prices are exclusive of applicable taxes. You are responsible for any VAT, GST, or sales tax in your jurisdiction.

The Service, including all software, design, content, and features, is owned by Inuson International Inc. and protected by intellectual property laws. You retain full ownership of all data and content you upload to the Service ("User Content").

By using the Service, you grant TabEmail a limited, worldwide, royalty-free license to process, store, and transmit your User Content solely for the purpose of providing the Service to you. You may not copy, modify, distribute, or resell any part of our Service without explicit written permission.

Your use of the Service is also governed by our Privacy Policy, incorporated into these Terms by reference. By using the Service, you consent to data practices described therein.

You are independently responsible for ensuring your use of the Service — including all personal data processed through it — complies with applicable privacy laws including GDPR, CCPA, and CAN-SPAM where applicable.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, TABEMAIL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted or error-free operation, inbox placement, or specific campaign performance outcomes. Your use of the Service is at your sole risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TABEMAIL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO TABEMAIL IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

You agree to defend, indemnify, and hold harmless TabEmail and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the Service in violation of applicable law, your User Content, or claims by third parties resulting from your email campaigns.

TabEmail may suspend or terminate your account at any time, with or without cause, including for violations of these Terms. You may cancel your account at any time via account settings or by contacting support. Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 10, 11, and 13 survive termination.

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions. Any dispute shall first be attempted through good-faith negotiation, and if unresolved, submitted to binding arbitration under the American Arbitration Association in Santa Clara County, California. You waive any right to participate in a class action lawsuit or class-wide arbitration.

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and, where feasible, by email. The "Last Updated" date at the top reflects the most recent revision. Continued use of the Service after changes become effective constitutes your acceptance.
